Auto v. Uninsured DUI Driver

Published: 10/10/2022

Our client was the driver of a vehicle that was T-Boned by another vehicle. The driver of the other vehicle was under the influence and did not carry insurance. Fortunately, there was uninsured coverage under which we were able to submit a claim.

During the Collision, our client sustained injuries to her neck and low back, including 4 – 5 mm disc herniations in her cervical spine and 2 – 8 mm disc herniations in her lumbar spine. Her injuries affected her mobility so severely, her lifestyle was completely and forever changed. She went from being a completely independent and active individual and the sole provider for her family, to being someone who couldn’t even get out of bed for days due to the pain she was in. She was forced to stop working completely and had to depend on her two children to help provide care for her.

The insurance company’s initial offer for was a whopping $25,061.69, which was nowhere near sufficient to compensate her or cover her medical bills. After about 5 months of negotiations with the insurance company, the case finally settled for more than 3x their original offer. Our client was really happy with the outcome and grateful that she can finally put this case behind her without having to step into court.

*A study by the Insurance Research Council found that people who hire an experienced lawyer after an accident file claims at least 3.5 times larger than those without one. No guarantees made, every case is different.
