Uber Driver Struck While Parked – $147,566

Our client is a veteran and an Uber driver who when letting a passenger off at a parking lot drop off zone, with hazards on, and got rear-ended. The at-fault driver accepted 100% liability. As a result of the accident, our client sustained a traumatic brain injury with post-concussive syndrome, a cervical herniation at C6-7 with radiculopathy, a right knee meniscal tear, left shoulder impingement with rotator cuff sprain, and lumbar sprain and strain.

Our client was very consistent with her treatment and saw a neurologist, multiple orthopedic surgeons, a chiropractor, and two separate physical therapy providers. She underwent MRIs of the brain, cervical spine, lumbar spine, right knee, and left shoulder, as well as EEG/EMG testing, cognitive rehabilitation, and multiple platelet-rich plasma injections for both her knee and shoulder. Her total medical bills came to $74,977.00, with documented lost wages of $27,987.00 as an Uber driver.

The at-fault driver’s insurer paid its $15,000 policy limits, leaving a significant gap. We submitted an Underinsured Motorist Demand to the insurance and the initial offer was $35,000. The challenge here was that the insurance was only covering General damages because of their expectation was that initial insurance policy was going to pay the Special damages. I was able to persuade the insurance to pay out both Generals and Specials and then recoup the Specials cost from Intact once the case settled. Then we got an offer of $101,000. We pushed back hard on the pain and suffering — particularly her debilitating knee episodes occurring 8 to 11 times daily and her TBI which directly impacted her ability to work — and emphasized that her treating physician had recommended a $165,000 cervical spine surgery still on the table, and that she remained in active treatment. We ultimately settled the UIM claim for $132,566, bringing her total recovery to $147,566.
